Ala Parte is a marketplace that allows users to offer, sell and buy just about anything in a variety of pricing formats and locations. The actual contract for sale is directly between the seller and buyer. Ala Parte is not a party to the transaction, and it is not a seller or a traditional auctioneer.
Any guidance we provide as part of our Services, such as pricing, shipping, listing, and sourcing is solely informational and you may decide to follow it or not. Also, while we may help facilitate the resolution of disputes through various programs, Ala Parte has no control over and does not guarantee: the existence, quality, safety or legality of items advertised; the truth or accuracy of users' content or listings; the ability of sellers to sell items; the ability of buyers to pay for items; or that a buyer or seller will actually complete a transaction or return an item.

Using Ala Parte
In connection with using or accessing our Services you agree to comply with this User Agreement, our policies, our terms, and all applicable laws, rules, and regulations, and you will not:
post, list or upload content or items in inappropriate categories or areas on our sites.
breach or circumvent any laws, regulations, third-party rights or our systems, Services, policies, or determinations of your account status.
use our Services if you are not able to form legally binding contracts (for example, if you are under 18 years old), or are temporarily or indefinitely suspended from using our Services, or are a person with whom transactions are prohibited under economic or trade sanctions.
fail to pay for items purchased by you, unless you have a valid reason as set out in an Ala Parte policy, for example, the seller has materially changed the item's description after you bid, a clear typographical error is made, or you cannot contact the seller.
fail to deliver items sold by you, unless you have a valid reason as set out in an Ala Parte policy, for example, the buyer fails to comply with the posted terms in your listing or you cannot contact the buyer
manipulate the price of any item or interfere with any other user's listings
post false, inaccurate, misleading, deceptive, defamatory, or libelous content
take any action that may undermine the feedback or ratings systems
transfer your Ala Parte account (including Feedback) and user ID to another party without our consent
distribute or post spam, unsolicited or bulk electronic communications, chain letters, or pyramid schemes
distribute viruses or any other technologies that may harm Ala Parte or the interests or property of users
use any robot, spider, scraper, data mining tools, data gathering and extraction tools, or other automated means to access our Services for any purpose, except with the prior express permission of Ala Parte
interfere with the functioning of our Services, such as by imposing an unreasonable or disproportionately large load on our infrastructure
export or re-export any Ala Parte application or tool, except in compliance with the export control laws, and rules and policies of any relevant jurisdictions
infringe the copyright, trademark, patent, publicity, moral, database, and/or other intellectual property rights (collectively, "Intellectual Property Rights") that belong to or are licensed to Ala Parte. Some, but not all, actions that may constitute infringement are reproducing, performing, displaying, distributing, copying, reverse engineering, decompiling, disassembling, or preparing derivative works from content that belongs to Ala Parte or someone else
infringe any Intellectual Property Rights that belong to third parties affected by your use of our Services or post content that does not belong to you
commercialize any Ala Parte application or any information or software associated with such application, except with the prior express permission of Ala Parte
harvest or otherwise collect information about users without their consent, or
circumvent any technical measures used to provide our Services.
Sellers must meet Ala Parte's minimum performance standards (see Code of Conduct). Failure to meet these standards may result in Ala Parte charging you additional fees, and/or limiting, restricting, suspending, or downgrading your seller account.
If we believe you are abusing Ala Parte and/or our Services in any way, we may, in our sole discretion and without limiting other remedies, limit, suspend, or terminate your user account(s) and access to our Services, delay or remove hosted content, remove any special status associated with your account(s), remove, not display, and/or demote listings, reduce or eliminate any discounts, and take technical and/or legal steps to prevent you from using our Services.
If we believe you are violating our policies prohibiting Offers to buy or sell outside of Ala Parte, you may be subject to a range of actions, including limits on your buying and selling privileges, restrictions on listings and account features, suspension of your account, application of fees, and recovery of expenses for policy monitoring and enforcement. If you are a seller and you offer or reference your contact information or ask a buyer for their contact information in the context of buying or selling outside of Ala Parte, you may be liable to pay a final value fee applicable to that item, even if the item does not sell.
We may cancel unconfirmed accounts or accounts that have been inactive for a substantial period of time. Additionally, we reserve the right to refuse, modify, or terminate all or part of our Services to anyone for any reason at our discretion.
Policy Enforcement
When a buyer or seller issue arises, we may consider the user's performance history and the specific circumstances in applying our policies. We may choose to be more lenient with policy enforcement in an effort to do the right thing for both buyers and sellers. The foregoing does not limit or impair our right to refuse, modify, or terminate all or part of our Services to anyone, or to terminate this agreement with anyone, for any reason at our discretion.
Fees and Taxes
The fees we charge for using our Services are a 3% flat rate on all categories. We may change our seller fees from time to time by posting the changes on the Ala Parte site 14 days in advance, but with no advance notice required for temporary promotions or any changes that result in the reduction of fees.
If you are a seller, you are liable for transaction fees arising out of all sales made using some or all of our Services, even if sales terms are finalized or payment is made outside of Ala Parte. In particular, if you offer or reference your contact information or ask a buyer for their contact information in the context of buying or selling outside of Ala Parte, you may be liable to pay a final value fee applicable to that item, even if the item doesn't sell, given your usage of our Services for the introduction to a buyer.
You must have a payment method on file when selling through our Services and pay all fees and applicable taxes associated with our Services by the payment due date. If your payment method fails or your account is past due, we may collect amounts owed by charging other payment methods on file with us, retain collection agencies and legal counsel, suspend or limit Services, and for accounts over 60 days past due, request that PayPal deduct the amount owed from your PayPal account balance. In addition, you will be subject to late fees. Ala Parte, or the collection agencies we retain, may also report information about your account to credit bureaus, and as a result, late payments, missed payments, or other defaults on your account may be reflected in your credit report.
In any jurisdiction where Ala Parte has an obligation to collect sales taxes on sales you make using our Services, we may collect such sales taxes from you via the payment method on file under the terms of the Billing Agreement or via any other means available to us.
Seller fees don't purchase exclusive rights to item exposure on our Services. We may display third-party advertisements (including links and references thereto) or other content in any part of our Services, in our sole discretion and without consent from, or payment, fee reduction, or other credit to, sellers.
Purchase Conditions
When buying an item on our Services, you agree to the Rules and policies for buyers and that:
You are responsible for reading the full item listing and images before committing to buy
You enter into a legally binding contract to purchase an item when you commit to buy an item
We do not transfer legal ownership of items from the seller to you
Returns and Cancellations
Sellers can create rules to automate replacements, returns, and refunds under certain circumstances. For all new sellers, in listings where returns are accepted, Ala Parte will set a default rule that automates the return process. Sellers may remove or customize their return preferences in their account settings within My Ala Parte. Where settings have been set to automatically accept requests for returns or replacements, an Ala Parte-generated return shipping label will be provided to your buyer. You agree to comply with our returns policy.
When an item is returned, to refund the buyer, you (as seller) authorize Ala Parte to request that PayPal remove the refund amount (in same or other currency) from your PayPal account, place the amount on your invoice, and/or charge your payment method on file.
The cost of return shipping for an item that is not as described is the seller's responsibility.
You (as seller) authorize Ala Parte to place the return shipping label cost on your invoice, subject to your automatic payment method on file when:
An Ala Parte-generated return shipping label is used, and the seller is responsible for its cost
Returns have been automated
You fail to send your buyer a return shipping label and, instead, an Ala Parte-generated shipping label is used; and/or
A transaction is cancelled, and to refund the buyer, you (as seller) authorize Ala Parte to request that PayPal remove the refund amount (in same or other currency) from your PayPal account. See canceling a transaction for more details.
Ala Parte Money Back Guarantee
Most Ala Parte sales go smoothly, but if there's a problem with a purchase, the Ala Parte Money Back Guarantee helps buyers and sellers communicate and resolve issues. You agree to comply with the policy and permit us to make a final decision on any Ala Parte Money Back Guarantee case.
If you (as seller), choose to reimburse a buyer, or are required to reimburse a buyer or Ala Parte under the Ala Parte Money Back Guarantee, you authorize Ala Parte to request that PayPal remove the reimbursement amount (in same or other currency) from your PayPal account, place the amount on your invoice, and/or charge your payment method on file. If we cannot get reimbursement from you, we may collect the outstanding sums using other collection mechanisms, including retaining collection agencies.

You must have an Automotive product to sell.
Be accurate and detailed in your description of the part (for new/used) and be fast at delivery
Presenting yourself as the seller to end customers
Ensuring that the products are all legal and complaint
Product Listing Conditions
When listing an item for sale on our Services, you agree to comply with Ala Parte's Listing policies and Selling practices policy and also agree that:
You assume full responsibility for the item offered and the accuracy and content of the listing,
Your listing may not be immediately searchable by keyword or category for several hours (or up to 24 hours in some circumstances). Ala Parte can't guarantee exact listing duration,
Your fixed-price listings may renew automatically every calendar month, based on the listing terms at the time, until all quantities sell or the listing is ended by you or Ala Parte, in its sole discretion,
The content you provide complies with all of our listing policies, including the Images and text policy (they should be immediate representation of item on sale),
Content that violates any of Ala Parte's policies may be modified, obfuscated or deleted at Ala Parte's sole discretion,
We may revise product data associated with listings to supplement, remove, or correct information,
We strive to create a marketplace where buyers find what they are looking for. Therefore, the appearance or placement of listings in search and browse results will depend on a variety of factors, including, but not limited to:
buyer's location, search query, browsing site, and history
item's location, listing format, price and shipping cost, terms of service, end time, history, and relevance to the user query
seller's history, including listing practices, Detailed Seller Ratings, Ala Parte policy compliance, Feedback, and defect rate; and
number of listings matching the buyer's query,
To drive a positive user experience, a listing may not appear in some search and browse results regardless of the sort order chosen by the buyer,
Some advanced listing upgrades will only be visible on some of our Services,
Ala Parte's Duplicate listings Policy may also affect whether your listing appears in search results,
Metatags and URL links that are included in a listing may be removed or altered so as to not affect third-party search engine results,
We may provide you with optional recommendations to consider when creating your listings. Such recommendations may be based on the aggregated sales and performance history of similar sold and current listings; results may vary for individual listings. To drive the recommendations experience, you agree that we may display the sales and performance history of your individual listings to other sellers,
For items listed in certain categories, subject to certain programs, and/or offered or sold at certain price points, Ala Parte may require the use of certain payment methods, subject to our Payments methods policy. For example, for inventory covered by authentication services, buyer and sellers may be subject to escrow and/or payment handling requirements,
You will not sell and will promptly remove all listings for any product recalled by a manufacturer or governmental agency if the sale of the product is prohibited by law or regulation or the product poses a health or safety hazard as specified by any governmental agency. Ala Parte has no responsibility or liability for the safety or performance of any product that you list or sell through the Services, including any product that is subject to a recall. You are solely responsible for any non-conformity or defect in, or compliance with any public or private recall of any product you list or sell through the Services.
Seller Code of Conduct Principles:
Adhere to all applicable laws and abide by Ala Parte policies.
Maintain current account information.
Never misrepresent yourself.
Always act in a manner that ensures a trustworthy experience for Ala Parte customers.
Never list products that may cause harm to Ala Parte customers.
Never engage in any misleading, inappropriate or offensive behaviour. This applies to all your activities, including but not limited to:
Information provided on your account
Information provided in listings, content or images
Communication between you and Ala Parte or you and our customers
Act fairly at all times. Unfair behaviour includes but is not limited to the following:
Behaviour that could be deemed as manipulation or "gaming" of any part of the buying or selling experience
Actions that could be perceived as manipulating customer reviews, including by directly or indirectly contributing false, misleading or inauthentic content
Activities that could be perceived as attempting to manipulate Ala Parte's search results or sales rankings
Actions that intentionally damage another seller, their listings or their ratings
Only maintain one Seller account for each region in which you sell, unless you have a legitimate business need to open a second account and all of your accounts are in good standing. Examples of a legitimate business justification include:
You own multiple brands and maintain separate businesses for each
You manufacture products for two distinct and separate companies
How payouts work
After a buyer pays for an item you sold, the funds minus applicable fees will show in your Processing funds, which means the order is confirmed and it's safe to go ahead and ship the item(s)
The funds will typically appear as Available for payout within 1 business day from the order confirmation, unless the transaction was placed on hold, in which case it may take longer
The payout will generally be initiated within 2 business days from the order confirmation (i.e. after providing proof of delivery). Once initiated, the payout status updates to Funds sent and it typically takes 1-3 business days for the funds to clear in your checking account and become available to you
This timeline is similar to the time it can take a credit card company to process your monthly payment, and depends on the processes of your financial institution
After the payout is initiated, the funds are no longer with Ala Parte. Ala Parte does not earn interest on any seller funds
A bank reference ID is available in Payout details, and can be provided to your bank to help you track your payouts
Some holidays can delay payout timelines. If your buyer's order is confirmed on an impacted holiday or weekend and
Your payouts are scheduled daily: the payout will be initiated 2 business days after the impacted holiday or weekend. For example, if the buyer's order is confirmed on Friday, and the holiday is on Monday, the payout will be initiated on Wednesday (2 business days later)
Your payouts are scheduled weekly: the payout will be initiated in the following scheduled weekly payout, on Tuesday. For example, if the buyer's order is confirmed on Friday, and the holiday is on Monday, the payout will be initiated on the Tuesday of the following week (8 days later)
When we initiate the payout, we'll send you an email and create a Payout ID to help you keep track of your transactions in Payouts reporting.

Why do I need to specify the location of the item in my listing?
Buyers like to know where the item is being shipped from as it helps to give them an idea of how much shipping will cost and how long it might take for the item to arrive. Having an inaccurate item location can cause confusion and lead to a poor experience for your buyer.
What should I include in my terms and conditions?
Be very clear and thorough about the terms of the transaction and include information about the forms of payment you accept, any taxes or other applicable fees, shipping and handling, and your return policy. Being upfront and honest about these terms helps build trust and provides a positive buying experience for your customers.
Do I have to accept returns?
You don't have to accept returns, but we highly recommend you do – it might help you attract more buyers. If you do accept returns, make sure you specify the time period in which you accept returns, who pays for the return postage, and how the refund is issued.
I'm not sure whether the item I'm selling is allowed on Ala Parte. Where can I learn more?
There are some items that, due to legal restrictions or Ala Parte rules, we don't allow or that can only be listed under certain conditions. If you're not sure whether your item is allowed, our Prohibited and restricted items policy has more details on what you can and can't sell.
Why was my listing removed?
To keep Ala Parte a safe place, sometimes we remove listings that violate our policies. If we remove your listing, we'll send you an email to your Messages and to your registered email address explaining why.
I can't find my listings on the site. What's happened?
If you can't find your listings they may have been removed if they violated one of our policies. However, if you haven't received an email from us about removing your listings, it's possible they're just not ranking high up in search results.
What should I do if my image or text is being used by another member?
When you create listings you give Ala Parte and it's members permission, through our user agreement, to use your images and product details. Your content may be added to the Ala Parte product catalog, and may be used by other sellers in their Ala Parte listings.
You may contact the member and ask them to remove your image or text from their listing if it is not part of the Ala Parte product catalog.
Can I use images that I copied from other websites in my listing or product page?
No, you can't use images copied from other websites or internet searches in your listing or product page, unless the owner of the image has given you permission. For example, it may be considered copyright infringement if you copy and paste an image from a manufacturer's website, unless you have permission.
Payment Method used by Ala Parte
To help provide a safe experience, we only allow payment methods that offer strong protection for buyers and sellers.
What is the policy?
The following payment methods are not allowed, including:
Sending cash through the mail
Point-to-point cash transfer services such as Western Union or MoneyGram
Direct contact information can only be exchanged after Ala Parte checkout is complete.
This includes asking buyers to get in touch with details of alternative payment methods.
The following payment methods, which are offered at Ala Parte checkout, are allowed:
PayPal
PayPal Credit
Credit card or debit card
Escrow
Activity that doesn't follow Ala Parte policy could result in a range of actions including for example: administratively ending or canceling listings, hiding or demoting all listings from search results, lowering seller rating, buying or selling restrictions, and account suspension. All fees paid or payable in relation to listings or accounts on which we take any action will not be refunded or otherwise credited to your account.
Why does Ala Parte have this policy?
This policy helps offer safe, simple payment methods, which strongly protect both buyers and sellers.
What changes for me when Ala Parte manages payments?
When Ala Parte manages your payments, your payouts will go directly to your checking account. Ala Parte will deduct fees, expenses and other selling costs directly from your payouts before they are sent to you. You can track the status of your payouts in Seller page. Regardless of how the buyer pays, Ala Parte will initiate a payout to you within 3-4 business days of confirming the buyer’s order.
How are fees different when Ala Parte manages payments?
When Ala Parte manages payments, your selling fees and other charges are deducted automatically from your available funds before they are paid out to you.
We charge one type of selling fee for most listings, 3% flat rate for all categories.
How do I get paid?
After providing proof of delivery (sent to our Email: payout@alaparte.com) You’ll receive your payouts to your checking account. Once Ala Parte initiates a payout to you, it typically takes your bank 1-4 business days to settle the funds into your checking account.
When will I get paid?
Once your buyer’s order is confirmed and you the “seller/vendor” provide proof of delivery, Ala Parte initiates your payout within 3-4 business days. It then typically takes 1-4 business days for your funds to clear into your checking account.
Why didn’t I receive my payout?
Once Ala Parte initiates your payout, it typically takes your bank 1-4 business days to settle the funds into your checking account.
If we need more information to verify your details, we’ll notify you by email messages.
When Ala Parte recoups funds
If an Ala Parte Money Back Guarantee claim or payment dispute is found in your buyer's favor, Ala Parte may issue a refund to the buyer on your behalf. In this case, we will recoup the amount from your Available, Processing, or On hold funds.
If your Available, Processing, and On hold funds are insufficient to cover the outstanding amounts you owe, Ala Parte will charge your on-file payment method within 14 days to recoup the full amount. We may add up the amounts you owe into a single charge. All the details related to these charges will be visible on your financial statement.
